BUSH WALK PARTICIPATION WAIVER & ACKNOWLEDGMENT OF RISK
1. Acknowledgement of Risk
I understand that participating in a guided bush walk involves inherent risks, including but not limited to:
- Uneven, steep, slippery or unstable terrain
- Exposure to weather conditions (heat, wind, rain, cold)
- Natural hazards such as rocks, cliffs, tree roots, wildlife and insects
- Physical exertion and fatigue
- Remote locations where medical assistance may be delayed
I acknowledge that these risks cannot be entirely eliminated and I voluntarily choose to participate.
2. Fitness & Medical Disclosure
I confirm that:
- I am physically capable of undertaking a moderate bush walk for up to 3 hours or more on Grade 3–4 national park trails.
- I have disclosed all medical conditions, injuries, allergies, or medications that may affect my participation.
- I will carry any personal medication required (e.g., asthma inhaler, EpiPen).
- I will immediately notify the guide if I feel unwell, injured, or unable to continue safely.
3. Instructions & Safety
I agree to:
- Follow all instructions given by guides and staff.
- Use recommended footwear and equipment.
- Act responsibly, respecting my own safety and the safety of others.
- Accept that guides may alter or cancel walks due to weather, tides, safety concerns, or park regulations.
4. Assumption of Responsibility
I accept full responsibility for my own actions during the walk and understand that participation is at my own risk.
5. Release & Waiver
To the fullest extent permitted by law, I release and discharge Elixir Journeys (including its owners, guides, contractors, and employees) from any liability for:
- Personal injury
- Loss or damage to personal property
- Accidents arising from my participation
Except where such liability cannot be excluded under Australian consumer law.
6. Personal Belongings
I understand that I am responsible for any personal items I bring on the walk and that Elixir Journeys is not responsible for loss, theft, or damage.
7. Weather, Conditions & Cancellations
I understand that:
- Weather and conditions may change rapidly in natural environments.
- Walks may be modified or cancelled for safety.
- Refunds or rebookings will follow the published cancellation policy.
8. Minors
Where participants are under 18, a parent or legal guardian must sign on their behalf.
